Our contract terms for ordering personalized bobbleheads.

These General Terms and Conditions apply to all orders placed by consumers and entrepreneurs through our online shop. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order. By clicking the "Order with payment obligation" button, you place a binding order for the goods in the shopping cart.
Confirmation of receipt of the order is sent immediately after submission by email. This does not yet constitute acceptance. The contract is only concluded through our declaration of acceptance or the delivery of the goods.
Important Notice: All bobbleheads, keychains and other personalized products ordered from us are goods made to individual customer specifications (photo, name, engraving, clothing, accessories, etc.) and clearly tailored to the personal needs of the customer. According to § 312g para. 2 no. 1 BGB, there is NO right of withdrawal and NO right to return, exchange or refund for such goods. The customer expressly acknowledges this upon placing the order.

The prices shown are final prices and include the statutory VAT. Additional delivery and shipping costs are stated separately in the respective product description.
Shipping to Germany is free. For deliveries abroad, additional costs may apply, which are displayed before completing the order.
Delivery is made to the address specified by the customer. The delivery times stated on our website or in the order confirmation (usually approx. 10 days after receipt of order and, if applicable, payment and after the customer's approval of the final preview) are non-binding guideline values only and expressly do NOT constitute a binding delivery date or a fixed-date transaction within the meaning of § 323 para. 2 no. 2 BGB. As each figurine is individually modelled by hand and we depend on suppliers, postal and customs services, delays may occur.
Any liability for meeting a specific delivery date – even at the customer's express request (e.g. birthday, wedding, Christmas) – is expressly excluded unless a binding fixed date has been confirmed by us in writing. Claims for damages due to delayed delivery are excluded unless we are guilty of intent or gross negligence. For express options, only priority processing applies, but no guarantee of a specific delivery day.
Payment is made via the payment methods offered in the order process. Payment is due immediately after conclusion of the contract.
All figurines are artistically modelled entirely by hand by our sculptors based on the photos provided by the customer. This is individual craftsmanship, not industrial reproduction. We always strive to achieve the best possible likeness, but give NO guarantee or assurance that the finished figurine will match the submitted photo or the actual appearance of the person 100%.
Deviations in facial features, proportions, skin tone, hair colour, clothing, colour nuances as well as slight asymmetries are due to the handcrafted nature and do NOT constitute a defect within the meaning of warranty law. They do not entitle the customer to price reduction, return, re-production or refund. The quality of the submitted photos (resolution, lighting, perspective) significantly influences the result and is the customer's responsibility. Before production starts, the customer receives a digital preview for approval; by approving, the customer bindingly accepts the depicted execution.
The statutory warranty rights apply to actual material defects (e.g. breakage, material defects, transport damage). Please report obvious transport damage to us immediately. In particular, craft-related deviations within the meaning of the section on handcrafted modelling as well as individual perceptions of likeness are not considered defects. Our liability for damages – for whatever legal reason – is limited to intent and gross negligence. This does not apply to injury to life, body and health, to claims under the Product Liability Act or to culpable breach of essential contractual obligations (cardinal obligations); in these cases we are liable for any negligence, but limited in amount to the foreseeable damage typical for the contract.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn.

By submitting photos to us, the customer warrants that they hold all necessary rights to the submitted images and that no third-party rights (in particular personality, copyright and trademark rights) are infringed. The customer indemnifies us against any third-party claims arising from the use of the submitted photos to create the figurine.
In addition, the customer grants us the non-exclusive, unrestricted (in time, territory and content), royalty-free right to use photos of the finished figurine (not the submitted personal photos) as well as preview renderings for reference and advertising purposes. This includes in particular publication on our website, on social media channels (e.g. Instagram, Facebook, TikTok, Pinterest, YouTube), in online and print advertising, newsletters and product catalogues. If the customer does not wish this, they may object to such use at any time informally by email to info@wackelwelt.de; the grant of rights then ends upon receipt of the objection for future uses.
Star ratings and customer reviews shown on our website and in our advertising materials come exclusively from independent external review services – in particular Trusted Shops (Trusted Shops GmbH, Cologne) and Trustpilot (Trustpilot A/S, Copenhagen). We ourselves do not create, alter or delete any reviews.
The authenticity of the reviews is ensured by the respective provider: after an order, the customer automatically receives an invitation from the review service to submit a rating that is uniquely linked to the order. This ensures that only verified customers can submit reviews (requirements under § 5b para. 3 UWG). The exact verification procedures can be viewed in the transparency information provided by the review providers (trustedshops.com or trustpilot.com). The respective external provider is responsible for the content of individual reviews and for the verification process.
